OFIS Posts Initial Pooling Application Materials
OFIS has posted the initial forms for pooling applications.
They have also posted a template for pro forma financials.
We plan to compare the application to a Multiple Employer Welfare Arrangement (MEWA) application and post a comparison between the two on the InfoCenter in the near future.
What does “Compile” Mean?
In responses districts are receiving to requests for claims data, it appears that MESSA has adopted an interpretation that “compiling” data means to “start to collect information as of the act’s effective date,” rather than simply re-configuring existing information for the previous 36 months as was the legislative intent. We expect that this interpretation will be challenged soon in the courts. As discussed in “Requesting Claims Data”, we firmly believe that database tools certainly allow claims data can be queried relatively easily. All carriers know which claims are attributable to which subscribers; and they know which subscribers belong to which employer. Within our TPA role, SET SEG frequently “compiles” data in just this manner.
Another term that is surfacing is “de-aggregating” the data. This term approaches the issue from the other direction, meaning that the required claims data is currently “compiled” at a regional level, and that it would require “de-aggregating” the data to comply with PA 106. This simply means that the data needs to be broken down by each individual school within a region.

No one expected the release of this data to be a straightforward issue; but we believe that in due time the intent of PA 106 will, in fact, be achieved.
